Discovery is the fact-finding phase of litigation & can be time consuming & costly.
While the court typically oversees the discovery process, its time and resources are limited. In complex cases or those with frequent or thorny discovery disputes, a Discovery Referee can timely and exclusively help the parties to resolve their discovery issues and keep their case on track.
Relatedly, Marin County requires parties to engage with a Discovery Facilitator before filing a discovery motion. The court may appoint a Resolution Remedies panelist to serve as Discovery Facilitator pursuant to Local Rule 1.13 The first few hours are pro bono, and if the parties wish to continue working with our panelist after the pro bono period, they may retain the panelist to serve as Discovery Referee at their usual hourly rate.
